Welcome to GenX Replicas (“GenX Replicas,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of https://genxreplicas.com/ (the “Site”) and any products or services purchased through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Overview
GenX Replicas designs and sells customized American football helmets and related accessories. All products are made to order based on customer-selected specifications submitted through our online customizer or sales team.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order on the Site. By using the Site, you represent that you meet this requirement.
3. Products and Customization
- All helmets and accessories are built based on the specifications (shell type, finish, facemask, decals, sizing, etc.) selected by the customer at checkout.
- Product images, colors, and finishes shown on the Site are for illustrative purposes. Actual products may vary slightly due to manufacturing processes, monitor display settings, or material batch variation.
- Custom logos, decals, or artwork uploaded by customers must not infringe on any third party’s trademark, copyright, or other intellectual property rights. See Section 9 below.
4. Orders and Payment
- All prices are listed in USD and are subject to change without notice.
- Orders are not confirmed until payment has been successfully processed.
- We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or inability to fulfill a custom specification.
5. Shipping and Delivery
- Estimated production and shipping timelines are provided on the Site and at checkout but are not guaranteed delivery dates.
- Risk of loss and title for products pass to you upon delivery to the shipping carrier.
- GenX Replicas is not responsible for delays caused by third-party couriers, customs, or events outside our reasonable control.
6. Returns, Exchanges, and Cancellations
- Because products are custom-built to order, customized helmets are generally final sale and not eligible for return or exchange except as required by law or as stated in our separate Shipping & Returns policy.
- Defective or damaged items must be reported to info@genxreplicas.com within 7 days of delivery with photo documentation.
- Order cancellations may only be accepted before production has begun on a custom build.
7. Helmet Safety Disclaimer
- GenX Replicas helmets are intended for the use described at the time of purchase. Any certification status (e.g., NOCSAE or other applicable standards) will be clearly stated on the relevant product page.
- Helmets are safety equipment. Improper fit, misuse, use in unauthorized or unintended activities, or use of a helmet that has been damaged, altered, or improperly maintained can result in serious injury or death.
- It is the customer’s responsibility to ensure any helmet is properly fitted, inspected regularly, and used in accordance with the manufacturer’s instructions and any governing league, school, or organization’s equipment rules.
- GenX Replicas makes no warranty that any product is suitable for use in any specific league, competition, or governing body, and customers are responsible for confirming compliance with applicable rules before use in organized play.
8. Limitation of Liability
To the fullest extent permitted by law, GenX Replicas shall not be liable for any indirect, incidental, special, or consequential damages arising from the use, misuse, or inability to use any product purchased through the Site, including but not limited to injury, loss of use, or loss of data. Our total liability for any claim relating to a product or order shall not exceed the amount paid for that product.
9. Customer-Submitted Content
By uploading a logo, image, or design to the Site for customization purposes, you represent that:
- You own the rights to the content or have permission to use it.
- The content does not infringe on any third party’s intellectual property rights.
- GenX Replicas may use the submitted content solely for the purpose of fulfilling your order.
GenX Replicas reserves the right to refuse any order containing content it believes may infringe on third-party rights or that is otherwise unlawful or inappropriate.
10. Intellectual Property
All content on the Site, including the GenX Replicas name, logo, graphics, and website design, is the property of GenX Replicas and may not be copied, reproduced, or used without prior written permission.
11. Prohibited Uses
You agree not to use the Site to:
- Violate any applicable law or regulation.
- Submit false or misleading information.
- Attempt to gain unauthorized access to the Site or its systems.
- Upload content that is unlawful, infringing, or offensive.
